User agreement

The user ("You") can access http://www.timestravelacademy.com ("the Site"), subject to the terms and conditions of use, as changed / updated from time to time entirely at the discretion of Bennett, Coleman & Co. Limited ("BCCL"/"We") as set out below. This Agreement is for an indefinite term and you understand and agree that you are bound by such terms till the time you access the Site.

Changes

We reserve the right to add to or change/modify the terms of this Agreement including but not limited to suspend / cancel, discontinue a service at any time without notice, make modifications and alterations in any or all of the content, products and services contained on the Site without prior notice. You will be deemed to have accepted such change/s if you continue to access the Site subsequent to such changes.

Copyright and trademarks

Unless otherwise stated, copyright and all intellectual property rights in all material presented on the Site including but not limited to text, audio, video or graphical images, trademarks and logos appearing on the Site are the property of Bennett, Coleman & Co. Ltd., its affiliates and associates and are protected under applicable laws. Any infringement shall be vigorously prosecuted and pursued to the fullest extent permitted by law.

Limited permission to copy

You are permitted to print or download extracts from these pages for your personal non-commercial use only. Any copies of these pages saved to disk or to any other storage medium may only be used for subsequent viewing purposes or to print extracts for personal use. You may not (whether directly or through the use of any software program) create a database in electronic or structured manual form by regularly or systematically downloading and storing all or any part of the pages from the Site. Individual registration, access and exchange of Information

For certain services such as email, personal web pages and contests, registration by the visitor is required. You will receive a password and account designation upon completing the registration on the Site. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. By registering, you agree to the following terms in addition to any other specific terms which shall be posted at an appropriate location of the Site. Each registration is for a single individual user only. To access these services, you will be asked to enter your individual User Name and Password. Therefore, we do not permit any of the following:-

• Access through a single User Name and Password being made available to multiple users on a network.

If we reasonably believe that a User Name and Password are being used / misused in any manner as stated above, we reserve the right to cancel access rights immediately without notice, and block access to all users from that IP address.

You specifically agree that we shall not be responsible for unauthorized access to or alteration of your transmissions or data, any material or data sent or received or not sent or received through the Site.

Exchange of information in relation to chat & other community services

All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials, whether publicly or privately transmitted/posted, is the sole responsibility of the person from whom such content originated (the Originator).

Our rights

We reserve the right to terminate your account without any prior notice for any violation of the Terms of Use.

Disclaimer of warranties and liability

Material submitted by users

Certain elements of the Site will contain material submitted by users. We accept no responsibility for the content, accuracy, conformity to applicable laws of such material. The user shall not impersonate, or falsely state or otherwise misrepresent your affiliation with, any person or entity, including, but not limited to, a BCCL official, forum leader, guide or host, forge headers or otherwise manipulate identifying information in order to disguise and/or with the effect of disguising the origin of any Content transmitted through the Site, upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).

Advertising material

Part of the Site contains advertising/other material submitted to us by third parties. Responsibility for ensuring that material submitted for inclusion on the Site complies with applicable International and National law is exclusively on the advertisers and we will not be responsible for any claim, error, omission or inaccuracy in advertising material. We reserve the right to omit, suspend or change the position of any advertising material submitted for insertion. Non transferability

You agree that your account on the Site is non transferable and any rights to your ID or contents with your said account automatically terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

Force majeure

We shall have no liability to you for any interruption or delay in access to the Site irrespective of the cause.

Waiver and Severability

Our failure to exercise or enforce any right or provision of the terms of use shall not constitute a waiver of such right or provision. If any provision of the terms of use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the other provisions of the terms of use remain in full force and effect.

Statute of limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services or the terms of use must be filed within one (1) year after such cause of action arose or be forever barred.

Indian Law

These presents shall be governed by the Laws of India. The Courts of law at Mumbai shall have exclusive jurisdiction over any disputes arising under these terms. The use of Site/services thereon is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

Entire agreement

These Terms of Use constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
